WORKERS COMPENSATION

  1. The employee was injured on the job resulting in a traumatic brain injury. The carrier argued that the claimant was not an employee of the leasing company on the date of the accident. Prior to the accident, the claimant had not been working for the on-site employer for several months while the job to which he had been assigned was temporarily shut down. He resumed working a few days before the accident, but his on-site employer did not initially include any time for the claimant when he submitted his payroll to the leasing company. Lance Avera successfully prosecuted this case before the Judge of Compensation Claims, resulting in payment of employee’s past medical bills, permanent total disability benefits, and 24-hour attendant care benefits payable to his spouse. The carrier appealed the decision. The First District Court of Appeals upheld the Judge of Compensation Claims’ order.
  2. The employee was performing roof demolition and fell off the roof, resulting in a traumatic brain injury. The carrier denied and defended the claim, alleging that there was no employer/employee relationship and that they were not the statutory Employer. Lance Avera successfully prosecuted the claim. The Judge of Compensation Claims determined that this was a compensable accident, that the employee was entitled to indemnity benefits, and that the employer is responsible for the employee’s past and future medical care. The carrier appealed the Judge of Compensation Claims’ order. The First District Court of Appeals upheld the Judge of Compensation Claims order.
  3. Employee was an electrician doing electrical work on a pole. While working, he was shocked and fell off the pole. Lance Avera obtained a $175,000 settlement on behalf of his client.
  4. The employee was involved in a motor vehicle accident while on her way to a client’s home. Lance Avera obtained a $375,000.00 settlement in regards to her workers’ compensation claim.
  5. The employee injured his back while at work, resulting in paraplegia. Lance Avera obtained a $750,000 settlement.
  6. After she was placed at maximum medical improvement, Lance Avera sought permanent total disability and supplemental benefits from the carrier for his client. The carrier denied this benefit, alleging that there was insufficient medical evidence to establish entitlement to these benefits. Lance Avera successfully prosecuted this claim before the Judge of Compensation Claims, who awarded the employee Permanent Total Disability and supplemental benefits from the date of maximum medical improvement and continuing.
  7. After Claimant was placed at maximum medical improvement, Lance Avera sought permanent total disability benefits from the carrier who denied this benefit, stating that there was insufficient evidence to establish entitlement to these benefits. Lance Avera successfully defended this claim before the Judge of Compensation Claims, who awarded the employee Permanent Total Disability from the date of maximum medical improvement and continuing.

PERSONAL INJURY

  1. Lance Avera obtained a $1,325,000.00 settlement on behalf of his client who sustained quadriplegia when riding his motorcycle and struck by a motor vehicle. The at-fault party’s insurance policy limit was 1,025,000.00. Lance Avera was able to obtain an additional $300,000.00 above the policy limits from the defendant’s personal assets.
  2. Auto crash. Lance Avera obtained a $2.8 M settlement on behalf of his clients.
  3. Auto crash. Lance Avera obtained a $275,000 settlement on behalf of his client who sustained a shoulder, neck, and low back injury sustained when she was rear-ended at a light.
  4. Auto crash. Lance Avera obtained $215,000 settlement on behalf o f his client who sustained a neck injury while rear-ended. The underinsured motorist insurance policy his client had initially offered only $25,000.00.
  5. Auto crash resulting in injury to the driver and the death of a child. Lance Avera obtained a $1.96M dollar settlement from one of the Defendants.
  6. Nicole, 19, was driving herself and her boyfriend, Charlie, 23, to work in Gainesville early one morning on State Road 24 when a truck owned by MasTec, Inc. crossed the center line of the two-lane highway resulting in a head on collision. Nicole was pronounced dead at the scene of the accident and Charlie was rushed to Shands in critical condition. He survived with a traumatic brain injury. Nicole’s wrongful death case settled for $2.6 million and Charlie’s case settled for $2.1 million.
  7. On 10/7/1999 Timothy’s vehicle was struck on the left front panel by defendant, Duane, who was attempting to change lanes at the intersection of SR 24 and SW 122 (Archer Road) in Gainesville. Allstate’s refusal to pay Timothy’s claim for damages (total loss of car in the amount of $1,500.00; car rental fees; storage fees) resulted in a bad faith claim with a $695,000.00 judgment in 2009.
